These Terms of Service ("Terms") govern your use of the physical and digital products and services provided by My Lasting Story LLC, an Illinois limited liability company ("Company," "we," "our," or "us"). By purchasing a Story Tag or accessing our software platform at https://mylastingstory.com or our storefront at https://shop.mylastingstory.com, you ("you" or "User") agree to be bound by these Terms.

1. Overview of the Platform

• Story Tags are physical NFC embedded products sold through our storefront or authorized resellers.
• Story Pages are unlisted digital memorial pages you can manage on our platform.
• Story Pages are private by design; there is no search, browse, or discovery functionality.
• Purchase of a Story Tag grants access to create and manage one Story Page.
• The platform is provided “as-is” without guarantees of uptime, feature completeness, or long-term availability.

2. Eligibility and Account Creation

• You must be 18 or older to purchase or manage a Story Page.
• You are responsible for safeguarding your account and credentials.
• If you use the Platform on behalf of another person or organization, you confirm you have proper authorization to do so.

3. Use of the Platform

3.1 Acceptable Use

• Do not publish illegal, defamatory, or harassing content.
• Do not upload copyrighted material you don't have permission to share.
• Do not impersonate others or misrepresent your identity.
• Do not spread spam, malware, or interfere with security.
• Do not use the platform for unintended commercial purposes.

3.2 Content Ownership and License

• You retain full ownership of lawful content you upload.
• You grant us a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, and display your content solely for the purpose of operating and improving the platform. You represent that you have the right to upload any content you share.
• We may remove content that violates law or these Terms.
• We may use anonymized data to improve services.

4. Story Tag Sales

• Story Tags are sold through our storefront.
• All sales are final unless a written refund policy applies.
• Tags are not guaranteed to be weatherproof or theft-proof.
• We are not liable for shipping carrier delays or damage.

5. Story Page Access and Reliability

• Pages are hosted on third-party cloud infrastructure and may go down temporarily or permanently.
• You are responsible for backing up any content you care about.
• We are not responsible for lost or corrupted files.

6. Privacy

• Story Pages are unlisted and accessible only via direct link.
• We do not index or list them publicly.

7. Suspension and Termination

• We may suspend or delete accounts violating these Terms.
• Severe violations (e.g., hate speech, illegal content) may result in immediate removal.

8. Intellectual Property

• All branding, designs, and source code are owned by My Lasting Story LLC.
• Feedback you submit may be used in our marketing.

9. Limitations of Liability

• We are not liable for indirect or incidental damages.
• Our liability is capped at what you paid us in the last 12 months.

10. Indemnification

• You agree to indemnify My Lasting Story LLC for any misuse of the platform or unlawful content you upload.

11. Changes to These Terms

We may revise these Terms at any time. Updates will be posted at https://mylastingstory.com/terms.

12. Governing Law

These Terms are governed by Illinois law. Any disputes will be resolved in McHenry County, Illinois.

13. Export Restrictions

Our services may be subject to U.S. export control laws and regulations. You agree not to use or access the platform if you are located in a country embargoed by the United States or if you are on any U.S. government list of prohibited or restricted parties.

14. Force Majeure

We are not liable for any failure or delay in performance resulting from events beyond our reasonable control. This includes but is not limited to natural disasters, internet outages, power failures, acts of war, civil unrest, government actions, or failures by infrastructure providers.

15. Survival

Any terms that by their nature should survive termination of this agreement will remain in effect. This includes, but is not limited to, provisions on content ownership, limitations of liability, indemnification, and governing law.

16. Feedback

If you choose to submit suggestions, feedback, or ideas to us, you grant us a non-exclusive, worldwide, royalty-free license to use, adapt, publish, and incorporate them into our products or services without compensation or credit.

17. Electronic Communication and Consent

By using the platform, you consent to receive notices, disclosures, and other communications electronically. You also agree that electronic agreements and signatures have the same legal effect as written ones.

18. Disclaimer of Warranties

The platform and Story Tags are provided “as-is” without any warranties of any kind. We do not guarantee that Story Tags will be weatherproof, theft-proof, or free from wear and tear. We make no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or compatible with all devices or systems.
